1. Agreement to Terms

By accessing, browsing, or using Tiranga Gaming (“Website,” “Platform,” “Service,” “we,” “us,” or “our”), you agree to be legally bound by these Terms and Conditions (“Terms”), our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you (“User,” “you,” “your”) and Tiranga Gaming.

This agreement is governed by and shall be interpreted in accordance with:

• The Consumer Protection Act, 2019

Tiranga Gaming is an educational and informational platform dedicated to:

• Providing publicly available data on gaming streamer earnings and revenue streams
• Educating users about legitimate ways to earn income through gaming content creation
• Sharing information about brand endorsement earnings of sports personalities
• Providing guides and resources for aspiring gamers, streamers, and esports professionals
• Promoting the growth of India's esports industry in a legal and responsible manner

• Brand Sponsorships and Endorsements: Paid partnerships with gaming brands, tech companies, and lifestyle brands
• Esports Tournament Prize Money: Winnings from officially organized, skill-based competitive gaming tournaments recognized under the esports framework
• Merchandise and D2C Sales: Creator-branded products and merchandise
• Affiliate Marketing: Commission-based product recommendations
• Professional Esports Salaries: Monthly salaries from esports organizations
• Sports Brand Endorsements: Legitimate sponsorship earnings of sports personalities

All of the above activities are recognized as legitimate, legal, and lawful economic activities under Indian law and international law.

3. Eligibility

• You must be at least 18 years of age to use this Platform independently. Users between 13 and 18 may use the Platform under verifiable parental supervision.
• By using this Platform, you represent and warrant that you are legally competent to enter into a binding contract under the Indian Contract Act, 1872.
• Users accessing from jurisdictions where the content of this Platform may be restricted must comply with their local laws. We do not target or solicit users from jurisdictions where our content would be unlawful.

4. Permitted and Prohibited Use

4.1 Permitted Use

You may use the Platform for lawful, personal, non-commercial, educational, and informational purposes in accordance with these Terms.

4.2 Prohibited Activities

You shall NOT:

• Use the Platform in violation of any applicable law or regulation including the IT Act, 2000
• Transmit harmful, malicious, defamatory, obscene, or unlawful content
• Attempt unauthorized access to our systems (punishable under Section 66 of the IT Act, 2000)
• Engage in any automated data scraping, crawling, or collection without written permission
• Use the Platform for or in connection with any gambling, betting, or wagering activity
• Impersonate any person or entity, or falsely state your affiliation
• Interfere with or disrupt the Platform's infrastructure or security
• Use the Platform to promote competing services without authorization
• Circumvent any technical measures designed to protect Platform content or user data

Violation of these terms may result in immediate termination of access and, where applicable, legal action under the IT Act, 2000 and the Indian Penal Code.

5. Content, Information, and Disclaimers

5.1 Accuracy of Earnings Data

• All earnings data is based on publicly available information, industry reports, and third-party estimates
• Actual earnings may vary significantly and are subject to market conditions, individual effort, and numerous other factors
• We do not guarantee any specific income, earnings, or financial results
• Past performance shown on this Platform is not indicative of future results
• Information is provided for educational and informational purposes only

5.2 No Financial, Investment, or Legal Advice

The content on this Platform does NOT constitute:

6. Intellectual Property Rights

All content on this Platform including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the overall design and arrangement (collectively, “Content”) is the property of Tiranga Gaming or its licensors and is protected by:

• The Copyright Act, 1957 (India)
• The Trade Marks Act, 1999 (India)
• The Information Technology Act, 2000
• International copyright treaties including the Berne Convention and WIPO Copyright Treaty

You may NOT reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Content without our express written permission. Unauthorized use may result in civil and criminal liability under applicable Indian and international intellectual property law.

Third-Party Trademarks: Names, logos, and trademarks of streamers, gaming companies, sports organizations and personalities mentioned on this Platform are the property of their respective owners. Their use herein is purely for informational and educational purpose and does not imply endorsement or affiliation.

7. User-Generated Content

If you submit comments, feedback, reviews, or other content to our Platform:

• You grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content in connection with our services
• You represent and warrant that you own all rights to the content you submit and that it does not violate any applicable law or third-party right
• You agree not to submit content that is defamatory, obscene, abusive, discriminatory, or that promotes illegal activity including gambling or betting

We reserve the right to remove any user-generated content at our sole discretion in compliance with the IT (Intermediary Guidelines) Rules, 2021.

8. Advertising, Sponsorships, and Affiliate Disclosures

• Affiliate relationships and sponsored content are clearly disclosed in compliance with ASCI guidelines
• We do NOT accept advertising from gambling, betting, or wagering platforms
• All advertisements comply with the Consumer Protection Act, 2019 and the ASCI Code of Self-Regulation in Advertising
• Advertising content does not constitute our endorsement of any product or service

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, completeness, reliability, or timeliness of any content
• Warranties of uninterrupted, error-free, or secure access to the Platform
• Warranties that results obtained from using the Platform will be accurate or reliable
• Warranties that defects will be corrected or that the Platform is free of viruses or harmful components

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY THE INDIAN CONTRACT ACT, 1872, THE CONSUMER PROTECTION ACT, 2019, AND OTHER APPLICABLE LAW:

• Tiranga Gaming shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform
• This includes but is not limited to loss of profits, data, goodwill, or other intangible losses
• Our total aggregate liability shall not exceed the amount you have paid to us (if any) in the 12 months preceding the claim
• We are not liable for any losses arising from decisions made based on information presented on this Platform

Nothing in this clause shall exclude or limit liability for death, personal injury, fraud, or any liability that cannot be excluded by applicable mandatory law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tiranga Gaming, its officers, directors, employees, agents, licensors, and service providers from and against all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the Platform; (b) your violation of these Terms; (c) your violation of any third-party right including intellectual property rights; (d) any content you submit through the Platform; (e) your violation of any applicable law or regulation.

12. Esports, Skill-Based Competitions, and Legal Distinction from Gambling

We acknowledge and affirm the legal distinction between esports/skill-based gaming and gambling under Indian law:

• The Supreme Court of India has recognized a distinction between games of skill and games of chance (State of Andhra Pradesh vs. K. Satyanarayana, 1968; Dr. K.R. Lakshmanan vs. State of Tamil Nadu, 1996)
• Esports and competitive gaming are recognized as legitimate professional activities that require substantial skill, training, and practice
• Tournament prize money in esports is awarded based on competitive skill and performance, not chance
• The Ministry of Electronics and IT (MeitY) recognizes online gaming (distinct from gambling) as a legitimate growth sector
• The IT (Intermediary Guidelines) Amendment Rules, 2023 establish a framework for online gaming that distinguishes permissible online games from gambling

This Platform only promotes and discusses esports activities that are recognized as legitimate under these legal frameworks and does not promote any activity classified as gambling under any applicable law.

13. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal data in compliance with the DPDP Act 2023, IT Act 2000, GDPR, and other applicable data protection laws. By using the Platform, you consent to data practices as described in the Privacy Policy.

14. Termination

We reserve the right to suspend or terminate your access to the Platform immediately, without prior notice, if:

• You breach any provision of these Terms
• We are required to do so by law, regulation, or court order
• Your conduct may create legal liability for us or other users
• We reasonably believe your use is harmful to the Platform, other users, or third parties

Upon termination, all provisions of these Terms which by their nature should survive (including intellectual property, disclaimers, indemnity, and limitation of liability) shall continue to apply.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved amicably. If not resolved within 30 days, the dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 as amended. The seat of arbitration shall be New Delhi, India. The arbitration shall be conducted in English.

15.3 Jurisdiction

Subject to the arbitration clause above, the courts of New Delhi, India shall have exclusive jurisdiction over any dispute arising from these Terms.

15.4 Consumer Protection

Nothing in this arbitration clause shall prevent you from filing a complaint with the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or approaching the National Consumer Helpline (NCH) at 1800-11-4000.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement and Waiver

These Terms, together with the Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and Tiranga Gaming concerning the Platform.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Tiranga Gaming.

18. Amendments to These Terms

We reserve the right to modify, amend, or replace these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the “Last updated” date. Where required by law, we will provide direct notice via email. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms.
